Clean Air Council takes aim at Sunoco pipeline

The Clean Air Council announced Thursday that it had filed a civil action against Sunoco Pipeline in the Philadelphia Common Pleas Court aimed at establishing that the company is not a public utility and does not have the right of eminent domain for a proposed natural gas pipeline project.

The Mariner East 2 pipeline would transport natural gas liquids like ethane and propane from Ohio and western Pennsylvania to the Marcus Hook Industrial Complex for export overseas, according to a CAC release.

The lawsuit argues that Sunoco Pipeline should not be allowed to use eminent domain to build that pipeline, however, because the project would not serve any public need and the company has not received the required regulatory authority.
